1. Scope

These terms of use apply to the use of the web application HolzBau 3D, operated by David Bohler, 43 Kneppchen, L-8538 Hovelange, Luxembourg (the “provider”). By registering for or using the service, the user accepts these terms.

2. Description of the service

HolzBau 3D is a browser-based software solution for planning timber structures in 3D. The service is offered as Software-as-a-Service (SaaS) and can only be used through a web browser. There is no entitlement to permanent, uninterrupted operation.

3. Free plan

• Planning timber structures in 3D with no limit on the number of parts
• Groups and layers, saving and loading projects as a file, parts list as CSV
• Saw tool (cutting to length, mitre, bevel) and the on-screen plan preview (top view, elevations, section and parts list)
• One project can be stored in the account; as a file on the user's own computer there is no limit
• Display of advertising by Google AdSense
• No export as PDF, DXF or CNC milling plan, no printing; no templates (except pergola and timber deck), no cutting-plan optimisation and no cost calculation
• No guarantee of permanent storage. For reliable safekeeping the user is expected to save to a file.

4. Premium subscription

• Made-to-measure templates (carport, garden shed, patio roof) and the fixed construction templates. The pergola template is free for all users and is not part of the subscription.
• Export as PDF, DXF and CNC milling plan, cutting-plan optimisation, panel cutting and material costing
• Saw and milling tools, decorative objects, mirroring, parallel rows
• No advertising

Billing is handled by Stripe at the prices displayed when the contract is concluded: €9.99 per month (monthly plan) or €99.99 per year (annual plan). Prices include statutory VAT. The premium subscription runs for an indefinite period and renews automatically for the term chosen — by a further month for the monthly plan, by a further year for the annual plan. The agreed amount is charged again at the beginning of each new term for as long as the user does not cancel. There is no minimum term and no notice period: cancellation is possible at any time up to the end of the current billing period and prevents any further charge. Users are reminded by e-mail of the upcoming charge around one week before each renewal.

4a. Project package (one-off purchase, 3 months)

As an alternative to the subscription, users may purchase a project package. It covers the same scope as the premium subscription (section 4) and is paid once, at a price of 24,99 € (including statutory VAT).

• Access starts immediately after payment and ends automatically 3 months later.
• It is not a subscription: the package does not renew, no further amount is charged, and no cancellation is required or possible. When it expires, the account switches to the free plan automatically; saved projects are kept.
• Users are reminded by e-mail around one week and again two days before the end of the term.
• There is no pro-rata refund if the package is not used. The statutory right of withdrawal for consumers remains unaffected.

5. Payment terms

Payment is handled exclusively by Stripe, Inc. The provider does not store any card or bank details. By taking out a premium subscription, the user authorises Stripe to charge the agreed amount on a recurring basis.

6. Cancellation

Users can cancel their subscription at any time under “My subscription”. Independently of this, consumers have a statutory right of withdrawal. Cancellation takes effect at the end of the current billing period. There is no pro-rata refund for periods already paid for, unless the provider has caused a serious outage of the service.

Free accounts may be deleted at any time without giving reasons. The provider reserves the right to block accounts without prior notice in the event of breaches of these terms.

7. User obligations

• The user may use the service for lawful purposes only.
• Automated access (scraping, bots) is prohibited without express permission.
• The user is responsible for the security of their own credentials.
• Sharing credentials with third parties is not permitted.

8. Disclaimer

Plans and calculations produced with HolzBau 3D serve solely as a planning aid. The provider accepts no liability for damage arising from the use of the planning results. Before any structure is built, it must be checked by a qualified professional.

The provider is not liable for the loss of data stored in the browser, for interruptions of the service or for technical faults.

9. Data protection

Personal data is processed in accordance with our privacy policy.

10. Changes to these terms

The provider reserves the right to amend these terms at any time. Changes are announced by updating this page. In the case of material changes, registered users are informed by e-mail (provided an e-mail address is on file). Continued use of the service after changes have been announced is deemed acceptance of the amended terms.

11. Applicable law

The law of the Grand Duchy of Luxembourg applies. The place of jurisdiction is Luxembourg City, to the extent permitted by law.
